Please read this before buying a phone from b4utele.com.

The phones this company supply are Grey Imports, you will have NO warranty, and NO customer support in the EU. This means that if you need either a firmware upgrade or a repair in the EU, you will not be able to without cost to yourself, as Nokia no longer offer a worldwide warranty, it is specific to the area the phone was destined to be sold in.

Further to that if you do get a firmware upgrade done it is not until afterwards when you collect your phone from the Nokia service centre that you find that the phone has now become an expensive paperweight.

The company is based in the UK in birmingham but do not let that fool you, please read all the FAQ's and Terms and Conditions on their site before buying as I didn't. (Straight from Froogle to the page where the phone is and on to the checkout.) Nowhere does it tell you that you have no warranty or that the phones are shipped from asia, unless you go back to the index and read links from their homepage. (The Terms link is in fine print right at the bottom of the page.)

I am now in the midst of a legal wrangle to get an N93 shaped door stop repaired that is only 3 weeks old.

Do your products come with any warranty? Or are they covered by any guarantee?

All products are covered by a Limited Warranty Coverage with B4Utele only. This provides a level of protection to our customers. Manufacturer warranty is not present unless otherwise stated on the procduct page. For more information, please review our Terms and Conditions.

This is what they say on their website...

Yes I know, unfortunately I didnt read this till I had a problem. The path I took was from froogle, so the main page was bypassed. I'm not really sure that what they are doing is legal, this I will find out over the next few days. I know now in hindsight that I should have read the terms and so on but I was stupid i suppose.

I'm just don't want anyone else to fall into the same trap as I did. I have been informed by the Nokia Service Centre that they may be breaking the Trading Standards Laws, but i'm not sure at the moment. I will be looking into it over the next few days before making any bold statements. I haven't posted anything on here that isn't true, I just think it's not very fair and a bit misleading.

It just goes to show that if it seems too good to be true, it probably isn't!

Hi Phil,

You can cancel your order within a certain period of ordering (i think it's 7 days from the date of receiving it, but its in their terms page anyway). To answer your question regarding the phone itself, the manual is in english and the one i had was from hong kong, but to use the phone you wouldn't know any difference from an EU spec one.

Since making the original post, i have done some digging around, but as to whether what they are doing is illegal or not i'm not sure at the moment, i'm waiting for a phone call from the distance selling rep at the DTI. As regards your rights as a UK consumer, i have found out from the Trading Standarts Institute (TSI) that you are entitled to full UK consumer rights as detailed in the "Sale of Goods act 1979 (as amended)" as you are dealing with a UK based company.

This means that they have to by law offer you a full unconditional refund on faulty goods or "not fit for purpose" or repair at their cost, or replace with an agreeable replacement, regardless of what may be printed on the website. Its UK law.

Also, if you used a credit card for payment then the credit card company has equal rights under section 75 of the "consumer credit act 1974". So it may be worth contacting them if you run into problems.

Having said all that, since originally posting the company has agreed to fix the phone for us and and meet the costs themselves, as yet i'm waiting for the phone to be returned but they seem to be very reasonable about it at the moment. Quite why this is i'm not sure as the first time i contacted them they were quite adamant about pointing out that there was no warranty, Yet a day later when i rang them back they were suddenly "all too willing" to help.

I will keep you posted....
